TERMS + CONDITIONS
1. Health, Safety & Assumption of Risk
The Client/Model acknowledges that participation in a photoshoot may involve inherent risks, including but not limited to physical injury, environmental hazards, travel-related risks, or property damage.
The Client voluntarily assumes full responsibility for any risks, injuries, or damage that may occur during or as a result of the session.
The Photographer will take reasonable care to maintain a safe working environment but cannot control all conditions, especially in outdoor, public, or rented locations.
The Client agrees to:
Follow all safety instructions given by the Photographer
Communicate clearly if any pose, movement, or situation feels unsafe or uncomfortable
Take full responsibility for their own wellbeing and personal limitations
2. Technical Issues & Data Loss
The Photographer takes the utmost care in handling equipment, files, and digital processing. However, in the unlikely event of technical failure (including but not limited to camera malfunction, memory card corruption, storage failure, or software error), the Photographer shall not be held liable for lost or compromised images.
In such cases, liability is strictly limited to the return of payments made by the Client.
3. Force Majeure
The Photographer shall not be held liable for failure or delay in performance due to circumstances beyond reasonable control, including but not limited to:
Severe weather conditions
Natural disasters
Illness or injury
Government restrictions
Pandemics or travel disruptions
The Photographer reserves the right to:
Interrupt or reschedule a photoshoot or photo tour if necessary
Change location if the original location becomes unsafe, inaccessible, or unsuitable
In such cases, reasonable efforts will be made to reschedule. If rescheduling is not possible, liability is limited to a partial refund of payments made, minus costs already incurred.
4. Limitation of Liability
The Photographer’s total liability for any claim, loss, or damage arising under this Agreement shall not exceed the total amount paid by the Client.
5. Booking, Pricing & Payments
Prices valid at the time of booking apply but are subject to change without notice
Bookings are only secured upon receipt of the non-refundable down payment
Prices are guaranteed for one (1) month after booking with deposit
All prices are in USD and exclude 6% ABB Tax
Non-refundable Down Payment:
Half-day: $250 + 6% ABB Tax
Full day: $550 + 6% ABB Tax
6. Additional Fees
International wire transfer fee: $25 (Client agrees to SHA – shared costs)
Weekend surcharge: $150 + 6% ABB Tax
Additional person: $50 per person + 6% ABB Tax
Part Payment plans available. Admin fee $15 per payment
7. Scheduling & Timing
Photoshoots are scheduled depending on light, weather, season, and location, or studio availability, typically between approximately 08:15 and 18:00.
Exact timing is determined by the Photographer to ensure optimal results.
8. Locations & Transport
Included locations are within a 10 km radius and accessible via standard roads (e.g., Salt Mines, Sorobon, 1000 Steps, Seru Largu).
Additional or off-road locations are subject to custom pricing
Client is responsible for arranging their own transportation unless otherwise agreed
Pickup service available upon request
9. Tourists & Weather Policy
In case of heavy rain and inability to reschedule due to departure dates:
The shoot may be moved to the studio or
10% of the down payment may be refunded (cash, studio pickup)
10. Client Responsibilities
The Client is responsible for:
Arriving on time
Personal preparation (wardrobe, grooming, etc.)
Transport, entry fees, refreshments, sun protection, and personal needs
The Photographer is not responsible for missed opportunities due to lateness or lack of preparation.
11. Artistic Direction & Creative Control
The Client acknowledges that they are hiring the Photographer for their unique artistic style and vision.
The Photographer retains full creative control over:
Composition
Posing guidance
Editing style
Final image selection
No unedited/raw images will be delivered.
12. Image Selection & Post-Processing
Final delivered images are selected and edited at the Photographer’s discretion.
The Client understands and agrees that:
Editing style is consistent with the Photographer’s portfolio
Simple sessions: Editing is included (color grading, minor adjustments) Extensive retouching (skin retouch, body reshaping, complex edits, object removal, etc.) is not included, however can be purchased as an added-on service.
Signature Sessions include editing and retouching (color grading, skin retouch, body reshaping and object removal) Complex compositing, illustrative postprocessing and fine art retouching is not included and can be purchased as an add-on service.
Revision Policy:
One (1) reasonable round of minor adjustments is included
Any additional edits or repeated change requests will be billed at an hourly rate
The Photographer reserves the right to decline excessive, unrealistic, or stylistically inconsistent edit requests.
13. Cancellations & Rescheduling
Down payments are non-refundable
One time rescheduling is possible once with sufficient notice (minimum 48 hours), last-minute cancellations result in loss of payment
14. Copyright & Usage Rights
All images remain the intellectual property (copyright) of the Photographer.
The Client receives a limited license for use as follows:

The Photographer retains the right to use images for:
Portfolio
Website
Social media
Marketing and commercial purposes
(Unless otherwise agreed in writing)
15. General Disclaimer
The Photographer is not responsible for:
Weather conditions
Environmental factors
Third-party interference
Accidents or personal incidents
16. General Disclaimer
Client is responsible for file download within three days, the automatic expiration timeframe of the transfer service.
Fail to download in time leads to an additional fee of 75, - plus 6% tax to initiate a new download option.
17. Backup
Client is responsible for file backup.
18. Self printing
For printing please be aware, that colors and brightness varies highly depending on the printed medium and print lab. A test print is generally recommended. Request assistance from a pro lab to adjust settings according to their print specifics. Client is fully responsible for self-printed products. Digital files are limited to a maximum print size of 20x30cm / 8x12". For larger prints please contact me.
